Aquarobotman Underwater Drone Product Terms of Use
Thank you for your attention to the underwater drone product (the "Product") provided by Shenzhen Aquarobotman Science and Technology Co., Ltd. ("Aquarobotman"). Please read the following terms carefully.
1. Before accepting these terms, you have made the following representations and warranties to us:
(a) If you are under the age of 18, you must use this product with your guardian ; (b) the use of this product in compliance with all applicable laws and regulations. If you use the Product in the name of an entity, organization or company, you represent and warrant that you have the right to bind the organization to these Terms and that you agree to be bound by these Terms in the name of the organization.
2. Feedback
If you choose to provide advice related to this product ("Feedback"), you hereby grant Aquarobotman an unrestricted, permanent, irrevocable, non-exclusive unlicensed right so that Aquarobotman can use the feedback in any way and for any purpose, including improving the Product and creating other products and services.
3. Your obligation
You warrant that use of the Product in compliance with the Copyright Law of the People's Republic of China, the Regulations on the Protection of Computer Information Systems of the People's Republic of China, the Protection of Information Network Communication Rightsand applicable laws,regulations, and implementation method. The Aquarobotman also welcomes users to report any user content that violates applicable laws and regulations.
4. Materials
The visual interface, graphics, design, assembly work, information, data, products, services and all other elements of the Product ("Materials") provided by Aquarobotman are subject to intellectual property laws and other legal protection. All materials contained in this product are the property of Aquarobotman or our third-party licensors.
5. Compensation
You will be responsible for your use of the Product and you should provide defense and compensation to Aquarobotman and its senior management, directors, employees, consultants (collectively, the "Aquarobotman Entities"). The Aquarobotman Entity is free from any liabilities, damages and expenses(including reasonable attorneys' fees and costs: (a) your access, use or use of the Product; (b) you violate any of the Terms, warranties or agreements referred to in these Terms, or any applicable laws or regulations; (c) you infringe the rights of any third party, including any intellectual property rights or publishing rights, confidentiality, other property or privacy; or (d) any dispute or matter between you and any third party.
6. Disclaimer; No guarantee
The Product and all materials and contents provided through this product are provided "as is" andThe Aquarobotman entity disclaims all warranties of any kind, express or implied, including: (a) warranties of merchantability, fitness for specific purpose, title, and enjoyability. Or any implied warranties of non-infringement; and (b) any warranties arising out of the trading process, practices or rules.
You understand and agree that your use of the Product or accessories, and the use or access to the Materials shall be at your own discretion and at your own risk.
The laws of some countries may prohibit the exemption from the terms of the guarantee, so your rights in different countries may vary.
7. Limitation of Liability.
In no event will the Aquarobotman entity indemnify you from any arising out of or in connection with your use of the Product, accessories, or any materials or content provided on the Product. Or punitive damages (including damages for loss of profits, loss of goodwill or other intangible losses.
Except as otherwise provided by the parties, the total amount of damages incurred by the Aquarobotman entity against you due to the use or inability to use any part of this product will be limited to 500 RMB/100 USD.
The laws of certain countries do not allow the exclusion or limitation of liability for subsequent or incidental damages. Therefore, the above limitations may not apply to you.
8. Governing Law
Any dispute or dispute arising from the provisions of the Law of the People's Republic of China, Aquarobotman, shall be submitted to the Shenzhen Nanshan District People's Court for settlement.
9. General Provisions
You agree that these Terms and the Privacy Policy and any other agreements expressly incorporated herein by reference constitute a complete and exclusive understanding and agreement between you and Aquarobotman regarding your use of the Product. Except as expressly permitted above, this clause may only be modified by an agreement signed in writing by an authorized representative of the parties to the Terms. If any part of these Terms is deemed to be invalid or unenforceable, such unenforceable parts will be deemed to be valid to the greatest extent possible and the remainder will remain in full force and effect.
